Terms and Conditions for Mozika

1. Agreement to Terms

By accessing or using the Mozika mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Mozika ("we," "us," or "our").

2. Eligibility

Age Requirements

  • You must be at least 13 years old to use the Service
  • If you are between 13 and 18, you must have parental or guardian consent
  • By using the Service, you represent that you meet these age requirements

Account Requirements

  • You must provide accurate and complete information
  • You must maintain the security of your account
  • You are responsible for all activities under your account
  • You must not share your account credentials

3. Account Registration and Security

Authentication

  • You can sign up using Apple Sign-In or Google Sign-In
  • You are responsible for maintaining the confidentiality of your authentication credentials
  • You agree to notify us immediately of any unauthorized access

Account Termination

  • You may delete your account at any time through the app settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your right to use the Service immediately ceases

4. License and Restrictions

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Service for personal, non-commercial purposes
  • Download and use the iOS mobile application
  • Stream music content available through the Service

Restrictions

You agree NOT to:

  • Copy, modify, or distribute the Service or any content
  • Reverse engineer, decompile, or disassemble the application
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or servers
  • Upload viruses, malware, or harmful code
  • Impersonate others or misrepresent your affiliation
  • Violate any applicable laws or regulations

5. Music Content and Intellectual Property

Content Ownership

  • All music content, including tracks, artwork, and metadata, is owned by us or our licensors
  • The Service interface, design, and code are protected by copyright and other intellectual property laws
  • Mozika® and related logos are our trademarks

Content License

  • Music content is licensed to you for streaming only
  • You may not download, record, or redistribute music content
  • You may not use content for commercial purposes
  • All rights not expressly granted are reserved

User-Generated Content

  • If you create playlists, we may use them to improve the Service
  • You retain ownership of your playlists
  • You grant us a license to use, store, and display your playlists

6. Privacy and Data Collection

Data Collection

  • We collect and use your data as described in our Privacy Policy
  • By using the Service, you consent to data collection and processing
  • You can review our Privacy Policy at mozika.co/privacy

Analytics

  • We use analytics to improve the Service
  • You can opt out of analytics by contacting us
  • Analytics data is anonymized where possible

7. User Conduct

You agree to use the Service responsibly and respectfully. Prohibited conduct includes:

  • Harassment, abuse, or threatening behavior
  • Posting offensive, obscene, or illegal content
  • Spamming or sending unsolicited messages
  • Attempting to manipulate recommendations or ratings
  • Creating fake accounts or impersonating others
  • Sharing accounts with multiple users
  • Using the Service to promote competing services

8. Recommendation Algorithm

How It Works

  • We use machine learning to recommend music based on your listening habits
  • Recommendations improve over time as you interact with the Service
  • We use factors like listening history, likes, skips, and completion rates

No Guarantees

  • We do not guarantee that you will like all recommendations
  • Algorithm performance may vary
  • We continuously work to improve recommendations

9. Service Availability

Uptime

  • We strive to provide reliable service but do not guarantee 100% uptime
  • The Service may be unavailable due to maintenance, updates, or technical issues
  • We will provide notice of planned maintenance when possible

Changes to Service

  • We may modify, suspend, or discontinue features at any time
  • We may change pricing or introduce new features
  • We will provide reasonable notice of material changes

10. Disclaimers and Limitations of Liability

AS-IS Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or errors
  • Unauthorized access to your data
  • Third-party actions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. These limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mozika, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your violation of applicable laws

12. Third-Party Services

Authentication

  • We use Apple Sign-In and Google Sign-In for authentication
  • These services are governed by their respective terms and policies
  • We are not responsible for third-party service failures

Links

  • The Service may contain links to third-party websites or services
  • We are not responsible for third-party content or practices
  • Your use of third-party services is at your own risk

13. Copyright and DMCA

Copyright Policy

We respect intellectual property rights. If you believe content infringes your copyright:

DMCA Notice Requirements:

  • Your physical or electronic signature
  • Identification of the copyrighted work
  • Identification of the infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury

Counter-Notices

If you believe content was removed in error, you may submit a counter-notice.

14. Dispute Resolution

Arbitration Agreement

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except:

  • Small claims court matters
  • Intellectual property disputes
  • Injunctive relief requests

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

Exceptions

Some jurisdictions do not allow arbitration agreements. If you reside in such a jurisdiction, this section may not apply.

15. Modifications to Terms

  • Continued use after changes constitutes acceptance
  • The "Last Updated" date will reflect the latest version

Rejection

If you do not agree to updated Terms, you must stop using the Service and delete your account.

16. Termination

By You

  • You may terminate your account at any time
  • Delete your account through app settings or contact us
  • Termination does not relieve you of obligations incurred before termination

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account is inactive for an extended period
  • Required by law or legal process

Effects of Termination

  • Your license to use the Service ends immediately
  • We may delete your data after a reasonable period
  • Provisions that should survive termination will remain in effect

17. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations.

Force Majeure

  • Beta features are provided "as is" with no warranties
  • Beta features may be changed or discontinued at any time
  • Your feedback on beta features is appreciated

20. Export Controls

You agree to comply with all applicable export and import laws. You represent that you are not:

  • Located in an embargoed country
  • On any government list of prohibited or restricted parties
  • Subject to export restrictions
